Welcome to UtahTributes.com (the “Site”). The Site is operated solely by IMC, a Utah corporation (“IMC”)
BY USING THE SITE, YOU AGREE TO BE BOUND BY THE TERMS AND CONDITIONS OF THIS USER AGREEMENT.
1. General Provisions
The material that appears on the Site is for informational purposes only. Despite the efforts of IMC to provide useful and accurate information, errors may appear from time to time. Before relying on the information or purchasing goods or services you've read about on the Site, you should confirm with the mortuary or vendor any information that may important to your planning to attend any service, or any purchase decision. IMC is not responsible for, and does not guarantee the performance of, any such goods or services.
The Site is an informational service. IMC can't verify all of the information supplied by mortuaries or families that create an obituary listing or claims made by advertisers. When using the Site, IMC urges you to use the same common sense and good judgment you would in viewing a traditional newspaper obituary.
IMC respects the privacy of visitors to the Site. We will not sell or distribute any information that we receive to any third party for any reason.
If you disagree with any material you find on the Site, IMC requests that you forward a copy of the material to IMC’s Customer Service Manager (info@utahtributes.com), or send a copy of the material by U.S. Mail to: Customer Service Manager, UtahTributes.com, 7325 Balboa Drive, Midvale , Utah 84047.
For your convenience, the Site contains links to other websites, not operated by IMC, where you can obtain information about related products and services. While IMC encourages you to consult such websites, IMC cannot guarantee the prices, terms, quality, reliability or performance of the products or services provided by these vendors. IMC is not responsible for the products or services these vendors provide.
The Web is an evolving medium. IMC may change the terms of this User Agreement from time to time. By continuing to use the Site following such changes, you agree to be bound by this User Agreement, as modified. IMC may change, restrict access to, suspend, or discontinue the Site, or any portion of the Site, at any time.
2. Ownership
The Site is made available for your personal, non-commercial use only. The materials on the Site are the property of IMC or its licensors, and are protected by U.S. copyright laws, international conventions and other copyright laws. Except as explicitly provided in this User Agreement, you may not distribute, transmit, display, reproduce, modify, create derivative works from, or otherwise exploit any on the materials on the Site. You may display and occasionally print a single copy of any page on the Site for your personal, non-commercial use, but you may not otherwise reproduce any material appearing on the Site without the prior written consent of IMC. You may not store any significant portion of, nor distribute copies of, materials found on the Site, in any form (including electronic means), without prior written permission from IMC.
Requests for permission to reproduce or distribute materials found on the Site should be sent to IMC Customer Service Manager by email (info@UtahTributes.com) or by U.S. Mail to: Customer Service Manager, UtahTributes.com, 7325 Balboa Drive, Midvale, Utah 84047. You are free to establish a hypertext link to the Site so long as the link does not state or imply any endorsement or sponsorship of you, your company, or your site by IMC. However, without the prior written permission of IMC, you may not frame any of the content of the Site, nor incorporate into another website or other service any intellectual property of IMC or its licensors. 3. Disclaimer of Warranties and Limitation of Liability
IF YOU RELY ON THE SITE OR ANY MATERIAL AVAILABLE THROUGH THE SITE, YOU DO SO AT YOUR OWN RISK. YOU UNDERSTAND THAT THERE MAY BE DELAYS, OMISSIONS, INTERRUPTIONS, INACCURACIES, AND/OR OTHER PROBLEMS WITH THE INFORMATION, PRODUCTS, AND SERVICES PUBLISHED OVER THE SITE. THE SITE IS PROVIDED TO YOU "AS IS." AND ITS AFFILIATES, AGENTS AND LICENSORS CANNOT AND DO NOT WARRANT THE ACCURACY, COMPLETENESS, CURRENTNESS, NONINFRINGEMENT, MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE OF THE INFORMATION AVAILABLE THROUGH THE SITE (OR ANY INFORMATION, GOODS OR SERVICES THAT ARE REFERRED TO, ADVERTISED ON, OR SOLD THROUGH THE SITE). NOR DO THEY GUARANTEE THAT THE SITE WILL BE ERROR FREE, OR CONTINUOUSLY AVAILABLE, OR THAT THE SITE WILL BE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
UNDER NO CIRCUMSTANCES SHALL IMC OR ITS AFFILIATES, AGENTS OR LICENSORS BE LIABLE TO YOU OR ANYONE ELSE FOR ANY DAMAGES OTHER THAN DIRECT DAMAGES, INCLUDING, WITHOUT LIMITATION, ANY LIABILITY FOR CONSEQUENTIAL, SPECIAL, INCIDENTAL, INDIRECT, PUNITIVE, EXEMPLARY, OR OTHER DAMAGES OF ANY KIND (INCLUDING LOST REVENUES OR PROFITS, LOSS OF BUSINESS OR LOSS OF DATA) EVEN IF IMC IS ADVISED BEFOREHAND OF THE POSSIBILITY OF SUCH DAMAGES. YOU AGREE THAT THE LIABILITY OF IMC AND ITS AFFILIATES, AGENTS AND LICENSORS, IF ANY, ARISING OUT OF ANY KIND OF LEGAL CLAIM IN ANY WAY ARISING OUT OF OR OTHERWISE RELATED TO THE SITE SHALL NOT EXCEED THE AMOUNT YOU PAID, IF ANY, TO IMC FOR USE OF THE SITE. BECAUSE SOME STATES/JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, SOME OF THESE LIMITATIONS MAY NOT APPLY TO YOU.

4. Miscellaneous
This User Agreement has been made in, and shall be construed in accordance with the laws of, the State of Utah. By using the Site, you consent to the exclusive jurisdiction and venue of the state and federal courts in Salt Lake County, Utah in all disputes arising out of or relating to this User Agreement or use of the Site
